Congresswoman Julie Fedorchak of North Dakota has voted in favor of H.J. Res. 35, a resolution she cosponsored aimed at overturning a methane emissions tax imposed by the Biden administration on petroleum and natural gas producers. This rule, finalized by the Environmental Protection Agency (EPA) in November 2024, places a per-ton tax on methane emissions from these systems, which Fedorchak argues creates uncertainty for producers and discourages investment in domestic energy infrastructure.
Fedorchak stated, “North Dakota is a leader in responsible energy production, and our producers have made tremendous strides in reducing emissions while keeping energy affordable.” She further criticized the tax as punitive to small and mid-size independent producers who contribute significantly to America’s natural gas supply. According to her, this measure threatens jobs in North Dakota, increases costs for families, and heightens dependence on foreign adversaries.
The rule introduces what is termed as a “waste emissions charge,” which Fedorchak claims disproportionately affects North Dakota’s energy sector. State officials estimate that similar regulations could result in approximately $38 million annually in lost revenue due to reduced royalties and oil and gas taxes.
“This tax hurts energy producers who are already doing it right,” Fedorchak remarked. She emphasized that American energy solutions are both clean and innovative without relying on federal mandates. According to her statement, “American energy is the cleanest in the world.”
H.J. Res. 35 was passed using the Congressional Review Act (CRA), enabling Congress to counteract federal agency actions before they fully take effect. Additionally, earlier this month, the House approved H.R. 77, known as the Midnight Rules Act, designed to nullify multiple last-minute regulations issued by an outgoing administration with a single vote.
Rep. Fedorchak also expressed her support for this resolution during remarks on the House Floor.
