Attorney General Drew H. Wrigley has announced a settlement with Vando Holdings Corp., K & L Products, LLP, Kristen Doka, and Ryan Doka, operators of the website Delta 8 Resellers. This settlement addresses claims regarding the sale and shipment of illegal vaping products to North Dakota residents, including minors. The settlement is awaiting court approval from the Burleigh County District Court.
Delta 8 Resellers, based in New Jersey, sells products such as hemp, THC, Delta 8 THC, kratom, and mushrooms, including vapes and edibles. The Consumer Protection and Antitrust Division investigated the company following reports of sales to a minor in North Dakota. It was found that some products offered were unlawful under North Dakota’s Food, Drug & Cosmetics Act and consumer fraud law.
Although Delta 8 Resellers denied the allegations of unlawful conduct, they have agreed to an Assurance of Voluntary Compliance to resolve the Attorney General’s claims. This includes ceasing sales to North Dakota for a year and implementing age-verification technology if sales resume. They will also pay a consumer refund and a $10,000 civil penalty, with $5,000 suspended upon compliance with the agreement.
Attorney General Wrigley stated, “The products sold by this company may be dangerous, and this settlement aims to stop this company from selling and shipping such products into our state that can harm North Dakotans.” He also criticized the company’s lack of age verification, labeling it as “unlawful, careless, and offensive.”
