North Dakota Department of Environmental Quality issued the following announcement.
The Office of Management and Budget (OMB) Initial Implementation Memorandum of the Bipartisan Infrastructure Law (BIL) included the SRFs as programs covered by Build America, Buy America (BABA) Act requirements mandating the use of domestic iron, steel, manufactured products, and construction materials in all funds obligated after May 14, 2022.
EPA is seeking comments on a proposed waiver concerning the application of BABA to Clean Water State Revolving Fund and Drinking Water State Revolving Fund (SRF)-funded projects. This does not apply to SRF assistance agreements closed (or those that have submitted engineering plans and specifications) prior to May 14, 2022. The agency is pursuing this waiver because it is not in the public’s interest to apply BABA requirements to projects that already submitted engineering plans and specifications due to the critical need to repair and upgrade our nation’s water infrastructure in a timely and cost-effective manner.
