Individuals aged 16 and older who wish to engage in darkhouse spearfishing must first register online at the North Dakota Game and Fish Department website, gf.nd.gov. This requirement is for those who already possess a valid fishing license.

Darkhouse spearing is accessible to all anglers with a valid fishing license, as well as youth under the age of 16. Northern pike and nongame fish are permitted for spearing throughout the state. Additionally, walleye can be targeted at specific locations such as Stump Lake, the Devils Lake complex south of U.S. Highway 2, and the Missouri River System. This includes lakes Oahe and Sakakawea and extends up to the first tributary bridge on the Missouri River.
