The City of Fargo has announced that its home rule charter and ordinance concerning approval voting procedures take precedence over the ballot requirements outlined in North Dakota Century Code Section 16.1-06-04 for electing city officials. As a home rule city, Fargo adopted an approval voting procedure through its charter powers and implementing ordinance. This means that the city's approval voting ordinance overrides any conflicting state laws regarding election procedures for city officials.
