BISMARCK – U.S. Senator Kevin Cramer (R-ND), member of the Senate Environment and Public Works (EPW) Committee, joined his colleagues in reintroducing the Real Emergencies Act. This legislation would clarify the president does not have the authority to declare a national emergency on the premise of climate change.
“The Biden administration has frequently used executive overreach to bypass congressional authority and advance their agenda of climate hysteria,” said Senator Cramer. “Progressives continue to call for a national emergency on the basis of climate change. This is a not-so-veiled power grab, and it is essential we double down to make clear the resident does not have the authority to declare a National Emergency because of climate change.”
Joining Senator Cramer are Senators Shelley Moore Capito (R-WV), John Barrasso (R-WY), John Boozman (R-AR), John Hoeven (R- ND), Cynthia Lummis (R-WY), Roger Marshall (R-KS), Pete Ricketts (R-NE), Dan Sullivan (R-AK), and Roger Wicker (R- MS).

Background:
Specifically, the Real Emergencies Act would prohibit the president from using the three primary statutory authorities available through the National Emergencies Act, the Stafford Act, and Section 319 of the Public Health Service Act, to declare a national emergency solely based on climate change. Actual national emergencies or major disasters, such as hurricanes and floods, may still be declared.
